Changes in Civil Sexual Assault Law – Civil Sexual Assault Episode 6

December 7, 2019

[music] I started practicing in the area of civil sexual assault because I wanted to give a
legal voice to the widespread problem of sexual abuse in society. Well I have been practicing in this area for about 18 years now and over that time I have
seen many changes. If I had to name the most important ones, I would say the, or our, understanding of the meaning of consent or the lack thereof of a victim. The dispelling of myths in the
area. There are many myths, such as that a child or woman invites sexual contact or that
the delay in reporting a sexual abuse means it didn’t happen or it wasn’t serious. There’s
also, I’ve also witnessed kind of a greater willingness to hold all members of society accountable
for sexual abuse, and here I am thinking of the legal doctrine of vicarious liability
in which employers are held responsible for the harms caused by their employees who have
committed sexual assault. Lastly, our deeper understanding of why it can take a survivor
of sexual abuse years, sometimes decades, to be psychologically capable of confronting
an abuser with public accusations. [music]
