The process of bringing a civil case to court
follows steps established by state or federal laws. Generally, the steps followed by a civil
litigation attorney include: Filing a summons & complaint stating the grounds
for the claim Serving a copy of the summons and complaint
upon the defendant Responding to the answer received from the
opposing party Engaging in discovery in which the parties
exchange documents and other information Motions practice wherein each side may file
various motions And finally preparing for and presenting a
trial before either a jury or judge Some states, such as Arizona, favor the resolution
of civil disputes and conflicts through mediation or arbitration. Civil litigation lawyers must
be ready to take a case to trial, but they must also be skilled and experienced in other
methods of dispute resolution.
