Randy Barnett: The Declaration of Independence & the Constitution [NSS 2018]

October 10, 2019

The Declaration provides the justification
for the Constitution. The Constitution does not justify itself,
we interpret the Constitution according to its original meaning. But, we interpret the Articles of Confederation
according to its original meaning, the Constitution of the Confederate States of America according
to its original meaning. But what makes our Constitution our Constitution? Well, it was the Declaration of Independence
that made our people one people. And also, what justifies following the Constitution? The fact that it says it’s justified doesn’t
make it so. The Declaration provides the political theory
that justifies the US Constitution. The Declaration identifies the ends and the
Constitution provides the means to those ends.
