The Conservative Plan To Amend The Constitution | AM Joy | MSNBC

October 10, 2019

>>>LAS VEGAS SHOOTING REIGNITING THE NATIONAL DEBATE ON GUNS AND NFL PROTESTS DIVIDING THE FREE SPEECH, THE FIRST AND SECOND AMENDMENTS HAVE BEEN AT THE CENTER OF HEATED PUBLIC DEBATE. ONE PERSON IS OFFERING A NEW CHANGE. SMASHING THE D.C. MONOPOLY, TOM COBURN MAKES HIS CASE FOR A CONSTITUTIONAL CONVENTION TO REMAKE THE CONSTITUTION IN THE IMAGE OF HIS CONSERVATIVE IDEALS. MORE SPECIFICALLY, SHRINKING THE FEDERAL GOVERNMENT AND GIVING MORE POWER TO THE STATES. IF YOU THINK THAT SOUNDS FARFETCHED, THINK AGAIN. ACCORDING TO MY NEXT GUESTS, THEY MIGHT JUST PULL IT OFF. TOM COBURN JOINS ME NOW. WITH ME IS THERESA TOMLINSON, THE MAYOR OF COLUMBUS, GEORGIA. I’M GOING TO START WITH YOU, SENATOR COBURN. DESCRIBE TO US BRIEFLY IF YOU WILL WHAT IT IS YOU WOULD LIKE TO SEE CHANGED IN THE CONSTITUTION.>>FIRST OF ALL, I WANT BE TO EMPHATICALLY DISAGREE WITH THE WAY YOU SAID IT. WE’RE TRYING TO RESTORE THE BALANCE OF POWER AMONG THE THREE BRANCHES WHICH THE CONGRESS HAS GIVEN AWAY AND NOW WE HAVE A FOURTH BRANCH, THE BUREAUCRACY THAT TELLS AMERICANS WHAT THEY’LL DO, HOW THEY’LL DO IT. YOUR CHARACTERIZATION OF A WHOLE NEW CONSTITUTION IS –>>IT IS A WHOLE NEW CONSTITUTION. YOU WANT AMENDMENTS. YOU WANT TO AMEND THE CONSTITUTION?>>WE WANT TO FOLLOW ARTICLE 5 OF THE CONSTITUTION WHICH SAYS YOU CAN HAVE AN AMENDMENTS CONVENTION AS LONG AS YOU SPECIFICALLY STATE WHAT AREAS YOU WANT TO TALK ABOUT WHEN YOU HAVE THAT. SO WE HAVE THREE AREAAREAS. ONE, WE THINK THERE OUGHT TO BE FISCAL RESPONSIBILITY. THE AVERAGE MILLENNIAL NOW IS ON THE HOOK FOR $1.5 MILLION OVER THE NEXT 50 YEARS. WE BELIEVE THERE OUGHT TO BE TERM LIMITS ON OUR ELECTED OFFICIALS. THE ADVANTAGE OF INCUMBENCY IS UNBELIEVABLE TO DEFEAT SOMEBODY THAT’S THERE AND FINALLY WE THINK THEK THE SCOPE AND JURISDN OF THE FEDERAL GOVERNMENT OUGHT TO BE WHAT IT SHOULD BE BY OUR FOUNDING FATHERS, A VERY LIMITED ROLE BUT VERY SPECIFIC AND VERY POWERFUL. WHAT IS NOT SPECIFICALLY SPELLED OUT FOR THE FEDERAL GOVERNMENT LEFT TO THE STATES AS IT SHOULD BE.>>MAYOR TOMLINSON, YOUR RESPONSE.>>YES. FIRST OF ALL, IF YOU’RE SIMPLY TRYING TO RESTORE IT, THERE’S NO NEED TO AMEND IT. THE BALANCED BUDGET AMENDMENT IS SORT OF A TROJAN HORSE. THAT’S WHAT THEY LEAD WITH. WE’VE HEARD OF THE DEEP STATEMENT BUREAUCRACY. THEY DON’T CARE ABOUT THE 200,000 FEDERAL ARMED LAW ENFORCEMENT BUREAUCRATS, SPECIFICALLY THE ATF. THERE ARE SOME EXTREMIST ELEMENTS THAT THEY LIKE THEIR INDEPENDENT MILITIAS. THEY DON’T LIKE THE GUYS IN THE ATF TO HAVE A HAWKEYE ON THEM. THEY DON’T CARE ABOUT THE FEDERAL MARSHALS. THEY’VE BEEN USED TO IMPLEMENT CIVIL RIGHTS OPINIONS AND OTHER OPINIONS IN THE STATE. CONSERVANCY, THAT IS AN AFFRONT TO ABSOLUTE STATE SOVEREIGNTY. WHAT THEY WANT TO DO IS DEFUND THE FEDERAL BUREAUCRACY, THE ARMED BUREAUCRACY AND KEEP THAT IN THE STATES. I HAVE TO TELL YOU THERE’S SOME TROUBLING INSURRECTIONIST CECESSIONISTS HERE. WE KNOW THEY’RE ENGINEERING TO HAVE A PERMANENT MAJORITY. IF THEY CAN KEEP THE ENGINEERED POLITICAL MINORITY, YOU’LL NEVER HAVE A TIP O’NEILL, JOHN LEWIS OR NANCY PELOSI TO GARNER THE NATIONAL STAGE.>>THE OTHER THING THAT MAYOR TOMLINSON POINTS OUT IS THAT ONE OF THE THINGS YOU’VE SEEN REPUBLICANS ALSO TURN AWAY FROM IS THE IDEA THAT THE FEDERAL GOVERNMENT SHOULD DO THINGS LIKE MEDICAID, MEDICARE, SOCIAL SECURITY, THE SOCIAL SAFETY NET THAT REPUBLICANS WANT TO SEE THAT BROKEN UP AND RETURNED TO THE STATES. WHAT ABOUT PEOPLE WHO FEAR THAT THAT KIND OF A SITUATION COULD LEAD, FOR INSTANCE, STATES IN THE DEEP SOUTH THAT DON’T CARE FOR THE POOR AT ALL? THAT THEY THEM E ESSENTIALLY TO THE WOLVES?>>WELL, FIRST OF ALL, THE CHARACTERIZATION WE’VE HEARD DOESN’T HAVE ANYTHING TO DO WITH THE U.S. FEDERAL MARSHALS OR ANYTHING ELSE. IT HAS TO DO WITH LIBERTY. FOR THE LAST 30 YEARS THE FEDERAL GOVERNMENT HAS TOLD THE AMERICAN PEOPLE WHAT TO DO, WHETHER IT’S REPUBLICANS OR DEMOCRATS.>>WHAT TO DO?>>LET ME FINISH MY POINT.>>YOU HAVE TO BE SPECIFIC WHAT TO DO ON WHAT?>>SHE SAID WE WERE AGAINST THE DEA, AGAINST ATF. THAT’S JUST A BUNCH OF GARBAGE. THERE’S NOTHING IN THIS. YOU HAVEN’T EVEN READ MY REBUTTAL TO MY COMMENTS AND GIVEN IT A FAIR SHAKE ABOUT –>>THAT’S WHY YOU’RE HERE. WE HAVE YOU. YOU CAN GIVE YOUR REBUTTAL IN PERSON.>>WELL, WAIT A MINUTE. YOU’RE ALLOWING HER TO SPEAK AND ALLOW HER COMMENTS AND NOT MY COMMENTS. YOU ARE ALLOWING ME TO SPEAK, I’M THANKFUL FOR THAT. WHAT I JUST HEARD HAS NOTHING TO DO WITH THE TRUTH AND THE 2 MILLION PEOPLE BEHIND THIS EFFORT. THE EFFORT IS TO RESTORE A BALANCE. YOU HAVE TO ADMIT, LOOK AT THE CONGRESS, WHETHER IT WAS DEMOCRATS OR REPUBLICANS IN CONTROL, WHAT DID THEY ACCOMPLISH? DID ANYBODY FIX SOCIAL SECURITY FOR THE FUTURE? NO.>>WELL, THE POINT IS, THIS IS THE KEY POINT, WE HAVE AN IRRESPONSIBLE CONGRESS ON BOTH PARTIES BECAUSE THEY’VE EXPANDED THEIR VOICE AND MORE OF THE DECISIONS OUGHT TO BE MADE AT HOME. I’M NOT FOR GERRY MANNED DERING.>>LET’S GO FOR SPECIFICS. DO YOU BELIEVE IN MEDICAID?>>ABSOLUTELY.>>WELL, WHAT THEY’RE REALLY TRYING TO DO HERE IS MAKE STATES SUPREME.>>THAT’S NOT TRUE.>>HOLD ON. ONE AT A TIME.>>WE HAVE A FEDERATION WHERE THERE’S A BALANCE OF POWER BETWEEN THE FEDERAL AND STATE GOVERNMENT. THIS IS ALL SPELLED OUT IN THEIR DOCUMENTS. THEY WANT TO MAKE THE STATES SUPREME SO THEY CAN REJECT FEDERAL LAWS THAT THEY DON’T CARE ABOUT.>>THAT’S NOT TRUE.>>YOU CAN REJECT THOSE LAWS. ALSO, THEY WANT TO –>>YOU KNOW, THE REASON WE’RE HEARING THIS –>>HOLD ON.>>THE REASON WE’RE HEARING THIS IS THE CITY OF COLUMBUS AND HER ADMINISTRATION GETS $1 BILLION A YEAR.>>SO WE CAN ACTUALLY HAVE UNITED STATES SUPREME COURT CASES OVERTURNED BY MAJORITY VOTES OF 2/3 OF THE STATES IN THE STATES. SO IT REALLY IS ABOUT RETURNING THIS TO A POINT WHICH WAS REJECTED IN 1787 THAT STATES WILL BE SUPREME TO THE FEDERAL GOVERNMENT.>>LASTLY, WOULD YOU AGREE, SENATOR COBURN, FORMER SENATOR COBURN, THAT GOING AWAY FROM THE ARTICLES OF THE CONFEDERATION ALLOW THINGS LIKE CIVIL RIGHTS TO GO THROUGH.>>SURE.>>ALLOWED SCHOOL TO BE IMMIGRATED.>>IF WE RETURNED ALL OF THE POWER TO THE STATES –>>FIRST OF ALL, THE ASSUMPTION OF YOUR QUESTION IS ERRONEOUS. WE’RE NOT TALKING ABOUT RETURNING ALL THE POWER TO THE STATES. THE MAYOR, GOD BLESS HER, DOESN’T WANT ALL THE POWER RETURNED TO HER. SHE’S DEPENDENT ON $1 BILLION.>>OUR BUDGET IS $270 MILLION BUT I’M GOING TO LOOK FOR IT WHEN I GET BACK TO COLUMBUS.>>YOU MIGHT GO TO OPEN THE BOOKS.COM AND ASK THEM TO SHOW YOU ALL THE MONEY THAT COMES TO COLUMBUS, GEORGIA.>>THERE’S NO BILLION BUT THANK YOU.>>THANK YOU VERY MUCH. I HAVE TO CALL A TIME OUT BECAUSE WE HAVE TO PAY FOR ALL OF THIS BY GOING TO A BREAK. THANK YOU BOTH FOR BEING HERE FOR THE DEBATE.>>>COMING UP NEXT, DONALD TRUMP COMMENTS ON HARVEY WEINSTEIN’S SEX SCANDAL. TA

  1. He needs to just make his points, if he has any. Saying, "that's not true", is not producing anything for his points. If the former senator had a point it would not be hard to edify. Alas, he has no productive point of view.

  2. Conservatives be like we have congress the senate and POTUS, but WAH LIFE'S NOT FAIR BECAUSE WE'RE TOO INCOMPETENT WAHH

  3. The conservative plan is to role back society to 1789. Hmmm you mean when there was slavery, women were possessions, only property owners were aloud to vote. The law has to be a living breathing organism that can work for today's society. I really don't
want states to have all the rights. It is too easy to give the majority the right to be as bad as they want to the minorities.

  4. He's a typical Republican, overbroad, vague, and argumentative when you don't hang onto every word slack jawed, agreeing with every citizen chocking idea he has. Who's he trying to impress with 2 million backing his proposition. That's a small minority in this country. They're coming out of the woodwork now with ways to turn the U.S. into a dictatorship.

  5. Never voting GOP again, they've screwed the pooch long enough.

Pure scum. This combative G-no-per. The lack of respect is palpable.

  6. States aren't sovereign, the Civil War settled all that. His third point on 'limited role'? 'very specific'? but 'very powerful'? 'everything else left to states'? You could float a battleship through those non-specific statements. History and much of what goes on today says you can't leave things to a bunch of guys in a bar. Arizona elected a guy to Congress that says Charlottesville was fake (dead protestor) and babbles about Jewish conspiracies.

  7. I'm all for a smaller federal government, more state's rights & state's power but there's a right way & a wrong way to do this. The tax payer's federal taxes will decrease & the money given to the states instead to be used by that state on what those citizens want & need. We all know the federal budget is paid by the working middle & working poor classes….not the rich. Lobbying the federal politicians by CEOs of big business would disappear. Legalizing recreational marijuana use in all 50 states & territories would be much easier with the tax revenue once again going to the state for their wants & needs….not to the crooked politicians in Washington.

  8. Coburn’s libertarian arguments ring hollow; his ‘you’re not letting me speak’ and filibustering by deflection are designed to make him look like the victim of the ‘liberal media’. He refused to say anything specific, and tried to feed viewers platitudes. He’s not trying to debate, he’s courting sympathy for the purportedly oppressed white male.

  9. COBURN IS A QUACK QUACK, QUACK QUACKING around the kiddy pool with all his other little baby ducks swimming round and round in circles getting NOWHERE

  10. Most Americans don't seem to understand their own Constitution anyway. Look how Conservatives interpret religious liberty and the 2nd amendment, they haven't got a clue. I'd be surprised if most have even read it.

  11. the only thing they should get rid of , is the electoral college. that way people will believe thier VOTE counts. the amount of voter suppression going on is ridiculous.

  12. A medical doctor Republican wants to rewrite the constitution to give more power to more independent states. If some states still had the power, there would have been slavery until-maybe-now, racial segregation, more voter tampering/hacking-assisted by Republicans, and gerrymandering-choosing voters they wanted to vote for them. How about "government of the people, by the people, for the people"?

  13. "restoring the constitution" according to how it was meant (according to Mr Coburn of course) ….. spinning bs, lack of reflection. Petulant little child.

  14. Good God. These men love to cry victim and how they want to speak over other folks. And they are being asked to get specific and they get mad.

  15. Translation: If you shrink government you are able to discriminate more easily. i.e. refusing service to anyone you choose, closing off capital to certain groups and no liability to adhere to the 1st amendment.

  16. Senator Coburn, cur, there is a REASON you are a FORMER Senator. Your very posture on AM Joy shows you think YOU are smarter, better, and should be obeyed without question. Also, the near constant throat clearing, grimacing and interrupting is definitely beneath respect for the opposing view. I believe you & your ilk are trying to re-make America into a 'corporatocracy' a land where the rules are written by the wealthiest.

  17. As a progressive I actually like the idea of more power to the States. I am tired of conservative Congressmen who live thousands of miles away determining what is good for my progressive state. Having them hold back our progressive progress. Let the conservatives live the way they want in their states and let us progressives live how we want in our states.

  18. This is a FRIGHTENING development! We NEED yo take this as SERIOUSLY as a life or death situation. A rewrite of the Constitution THAT OUR FOUNDING FATHERS WROTE to KEEP us as a INDEPENDENT DEMOCRACY! Any PATRIOTIC American will OPPOSE this political death warrant

  19. The GOP is a radical extremist lunatic party they need to be check soon and stop at their tracks and liberal need to start to push really hard at this conservatives attack on America democracy. They don’t like the new changing face of America and the fact that the majority view does not support their policies solutions so they are cheating at every opportunity. This pathological liars need to be stop for the constant disfranchisement of voters and their constant attacks to American democracy. They are party first above everything else. So much for patriotism please this people are traitors, immoral, fake Christians hypocrites and cheaters.

  20. I think it is time for an Civil Unrest – Once and for all we have to settle this – it is either us or the unholy south.

  21. "When they blamed terrorists and suspended the Constitution we didn’t wake up either." – Handmaid's Tale
    I'll just leave this here.

  22. Fascism is coming to America. Many of the most ardent über-american patriots, are the folks who detest democracy the most……

  23. MSNBC is garbage. Walking all over the people they bring in and disagree with. You just watched them trying to lynch someone that threatened their selfishness and crookedness.

  24. I HATE Donald Trump and used to be excited to see what Politico or NYT story that MSNBC decided to expand on but not anymore. Picking fights and pushing Democrat rhetoric. Some of your people are just like Trump. Used to see MSNBC as a sort of white light in these dark times but that light is flickering at best, and doing it less and less.

  25. Well, ya know, Joy and the mayor kind of ganged up on him.  Ms. Reid will nearly always have more liberals than conservatives in on any discussion, often leaving the conservative to fend for him-/herself against two or three opponents, including Ms. Reid.  She also doesn't let the former senator finish, and I've seen that before on her show.  She says something like, "That is simply not true," without proving it isn't true, and insists that the person she thinks is not telling the truth stop talking.  At least she is polite while not letting him finish, unlike, say Bill O'Reilly, with hundreds of his "guests" whom he shouted down so that his viewers would not be able to hear another side of the argument.  On the other hand, to her credit the mayor was prepared with a short, cogent presentation of her assessment of the constitutional convention proposal.  Mr. Coburn was not.  If he wanted to refute her contentions, his book should have included specific wording of one of his amendments, not just vague talk about restoring balance, the vague part being essential.  From the president on down, Republicans, almost to a man/woman, purposely avoid specifics, so that the listener can read whatever they'd like into the proposal.  As a result, while the GOP was able to attack the ACA in generalities for seven years, thus eroding support for the law among people who didn't like this or that part of it, they were completely unable to construct a replacement whose specifics would garner much more than 18% support from the American people, with the original law now receiving majority support.  This is likely to be repeated in the matter of taxation, immigration, infrastructure.  The president sets the tone and he doesn't care about details or successful outcomes for the American people, only his own image as a tough anti-Washington disrupter, the idea being disruption, so that he is at the top of the news every day, not getting anything productive done.  If the American people didn't need Washington, they would have long ago solved the problems wrought by globalization, the banking system, immigration, infrastructure on their own.  How 'bout getting rid of the interstate highway system and leaving the maintenance of highways to each municipality they pass through.  Sound like a good idea to improve our infrastructure? Would former Sen. Coburn agree to that?  No, what it comes down to, is that he wants the federal government to do just what he wants it to do, not recognizing that other people want the federal government to do other things that he doesn't care about.  Faced with that situation, Republicans today simply say, "We're right and you're wrong," not "Let's see if we can decide what the real priorities are, rather than what we personally want or don't want,  to keep our country strong and find a way to achieve those goals."  By the way, was the highest priority to keep the country strong the last two weeks making football players sing the national anthem?  If the president thinks so, we should make him and his vice-president prove it, not just assert it.  If not, stop distracting the country with symbolic matters that make absolutely no difference to the daily well-being of our 320 million people.

  26. Why is he wasting so much time and he is not making a good point at all? Can he make a clear and specific point on what he wants changed and why?

  27. So we have a well informed Democrat with logical rational arguments, and a boisterous Republican constantly trying to interrupt with lies, platitudes, and propaganda. This is a microcosm of the political situation in America.

  28. Coburn isn't worth his salt I'm from OK and he didn't help the poor here. He said 2 million people want this states rights stuff. 3 million didn't want the Republicians in the White House. We lost that one big time.

  29. There’s is NOTHING wrong with the Constitution of our Already Great America. The only major change needed in America is to get rid of the electoral college. It was designed to allow educated representatives to cast votes because there was no readily available accurate news to inform the average American of what was going on in America and about candidates. We needed electors to do what was best for America. But it got perverted within a few years into what it is today. If any changes are really needed, there are things called “amendments” that can be done. Why am I not surprised republicans would want to change our Constitution. But yet they’re supposed to be ALL about it. What hypocrites.

  30. The Senator is telling a Lie about the Federal Funding/Balanced Budget …..

If it is tied to Taxation that is a Self Imposed Constraint …… Here is the Truth …..

  31. The Russians couldn't have done a better job of displacing the US off its high and mightly pedestal had they invaded you. For the price of a few hundred Russian computer nerds and $100000 in Facebook ads, they have plunged the US into a coming civil war. WakeTFU before you let the Dotard hit the red button. Its not just you, a nuclear war will take all of us out.

  32. I disliked the GOP guest. Bringing people like him on makes you look bad. So- thumb down. You can have a different opinion- but don’t engage in a conversation that can’t be respectful.

  33. 1.  The one place the former congressman's point is valid is on Government Fiscal Responsibility.  So rather than amending the Consitution, let's start by Trump not being allowed to travel to Maralago every weekend and racking up a bill for the People of $35,000,000.  There is no bureaucratic branch of the government.  That's a dog whilstle to racists to normalize their idea of a "deep state" which is a RUSSIAN concept.
    3.  This man is a fascist.  He's trying to manipulate the conversation, interrupting, yelling at the host and guest (because they're female) and unable to sustain dialogue and threatened by facts.  So, a fascist.
    4.  His arguments fall squarely in the domain of white supremacists.  They agree with him 100% on this.  So by definition it's a bad idea.
    5.  Then he tries to force shade on his opponent by lying.  Typical fascist.

The man is un-American.  "Power to the states" is a dog whistle for white christians who want to impede the freedoms the Constitution provides to people that they disagree with or don't like because of their gender preference, religion, race, or based on their personal religious beliefs, or lack thereof – which in its least noxious form is theocracy and in its most, fascism.

  34. Coburn's proposal is intentionally simplistic to appeal to the unthinking 'rusted on' conservatives but its result will be the concentration of power to the political elite through the political parties – elected reps will have limited tenure but not the party's bureaucracy/leadership tenure. This proposal will strengthen the plutocracy by decentralizing.

  35. Are these conservatives aware of all sorts of gaps between the states their ideas will create. Consequences of these gaps could be deadly serious.

  36. That's funny because I think a constitutional convention should be used to end legalised bribery and severely regulate money in politics.

  37. Liberals act like they aren't hypocrites too. Charlottesville proved that. That was free speech. People being fired when what they express doesn't synch up with PC liberalism. Don't get me wrong, I'm a liberal. Liberals are the progress party and are right about 85% of the time imo, but still. Not all of their ideals are consistent.

  38. The hypocritical GOP wants to turn the test labs of democracy into the test labs of tyranny. That's what they mean by "states' rights." These are the same "states' rights" they used to defend segregation. If they get their way and overthrow the Constitution, we'll get fifty Governor Snyders ruling their states as dictators, with their new constitution as the legal foundation for their dictatorships.

  39. They're gerrymandering their way to overthrow the Constitution, which means their new government would not have the consent of the governed if they were to succeed.

  40. You have some realities of your own to face, DNC. You and the rest of the Democratic Party regulars lost those 1000 seats in the first place. You're practically putting the GOP in the position they want to be in to overthrow our Constitution. The Supreme Court is colluding as well, upholding gerrymandered districts as a way to protect the electoral pathway to overthrow the Constitution.

  41. What the heck is wrong with you. You let that Senator get a few words in. You are supposed to cut him off before he starts to rebutt any arguements. What kind of FAKE NEWS are you?

  42. Check this out regarding an Article 5 Convention:
    http://singlesubjectamendment.com/issues-regarding-an-article-v-convention-3/

  43. The first thing we ought to do is take your health care and your retirement fund from congress that would save a lot of money and especially if you want retirement funds for a 2 year stint in the House of Representatives. Coburn you don`t know what liberty is ! Your for a police state and your for succession which leads to civil war. You have 2 million people we have 200 million people. Your guilty of sedition and should be executed on the spot for Treason   !

  44. What this tells me is the US is ungovernable this large. And it's time we consider breaking up the country in 2 or 3 countries. The #1 benefit would be to end our military occupation of the world, our desire for hegemony.

  45. 3:25 How are term limits akin to gerrymandering? I thought term limits were generally supported by most people on the left…

  46. i dont know. this might not be the best solution, but would it be crazy to just let them have what they want? Let them do what they want in their own states. Then they wont be able to blame the federal government for their problems …and if half the population rebels or tries to move to liberal states to take advantage of luxuries like medicare, public parks or federally funded hurricane relief, we can just build a BIG WALL to keep them out. hehehe evil chuckle

  47. In an era of pundits who try to talk over others, with differing viewpoints, the production staff could do a better job ensuring all points are heard, simply by mixing the sound levels, so that the louder panelists can’t interrupt & shout down the other panelists;

And the network could provide an online archive, of extended discussions, where those interjected comments could then be accessed, by people who want to find out more about a particular issue.

Is that too much to ask?
