  1. If the parties have to campaign in every state, the party donor's influence per dollar will decrease. So the corporations and wealthy that dominate the donations in elections will not support this.

  2. The complexity of Lessig's proposed amendment would likely limit the amendment's popularity. Most citizens would find the proposal's language confusing, and political operations would leverage that confusion.

  3. Would powered interests fear a Supreme Court's sanctioning of faithless electors? Might not the prospects of influencing such electors enter into their calculus for determining their public reactions to a Lessig-like amendement proposal?
